By using this website and placing an order, you agree to be bound by the following Terms & Conditions. Please read them carefully before ordering goods through this site.

1. Definitions

In these Terms & Conditions:

“Agreement” means these Website Terms & Conditions and any applicable Order Confirmation.

“Company” means Sensory Designs

“Customer”, “you” or “your” means the individual or business placing an order.

“Goods” means the products provided by the Company.

“Specification Document” means any order confirmation, quotation, or documentation specifying Goods and price.

2. Scope

2.1 These Terms and Conditions apply to all orders for the sale of Goods through this website.

2.2 Before delivery, a Specification Document will be issued indicating the Goods and price. You must notify us immediately if you do not agree with the Specification.

2.3 Delivery times are estimates and are not guaranteed.

3. Price and Payment

3.1 Prices shown exclude VAT unless stated otherwise. VAT is added at the standard UK rate.

3.2 VAT exemption may be available for eligible items for registered charities or individuals with chronic conditions. A valid VAT Exemption Certificate must be submitted with the order.

3.3 We will invoice you after dispatch of the Goods. Payment must be made in full in accordance with the invoice.

4. Description of Goods

4.1 Goods must conform to the Specification Document only. Images on our website or in literature are representative; actual colours and designs may vary.

4.2 Specifications may be updated by the Company at any time.

5. Delivery

5.1 Delivery dates are estimates only. Time is not of the essence.

5.2 Risk in the Goods passes to you on delivery.

5.3 You must provide accurate delivery instructions. We are not responsible for failed delivery due to incorrect information.

5.4 Residential deliveries will be made to ground-floor entrances only.

5.5 If you fail to accept delivery, you are responsible for return, storage, insurance, and re-delivery charges.

5.6 Goods may be left on site only with your prior agreement and at your risk.

5.7 Waiting time charges may apply if delivery acceptance is delayed.

5.8 You must inspect Goods before signing for delivery; failure to do so limits refunds or claims.

6. Title

Ownership of Goods remains with the Company until full payment is received.

7. Your Responsibilities

7.1 You must:

Provide accurate information to allow delivery.

Pay using your own card, or with express permission if using another’s card.

Obtain necessary permissions for delivery.

7.2 You must compensate the Company for costs incurred due to your failure to comply.

7.3 Cancellation by you without proper notice may incur charges equal to our costs or full order value.

7.4 You confirm you are at least 18 and legally capable of contracting.

7.5 If your actions delay us, delivery timelines will be adjusted, and additional costs may be charged.

8. Our Obligations

8.1 We undertake to supply Goods as described in the Specification Document.

8.2 Where applicable, we ensure compliance with relevant UK safety regulations.

9. Specification Changes

9.1 Changes requested by you must be agreed in writing and may affect price and delivery.

9.2 The Company will respond in writing to change requests within 5 working days.

10. Warranty

10.1 Goods are warranted to be free from defects in materials and workmanship for 12 months after delivery.

10.2 Except as expressly stated, all other warranties are excluded.

11. Indemnity

You agree to indemnify the Company for all claims, costs, and expenses arising from your breach of these Terms.

12. Limitation of Liability

12.1 Our total liability is limited to the price paid for the relevant Goods.

12.2 We are not liable for loss of profits, business, or indirect losses.

12.3 We do not exclude liability for death or personal injury caused by our negligence, but are not liable for injury due to your failure to supervise use properly.

13. Termination

Either party may terminate the Agreement if:

The other party commits an unremedied material breach;

Insolvency events occur;

The other ceases to carry on business.

14. Intellectual Property

All intellectual property rights in designs and documentation remain the property of the Company.

15. Right to Cancel (UK Consumer Rights)

15.1 Consumers have the right to cancel orders (unless goods are bespoke/personalised) within a cooling-off period.

15.2 The cooling-off period ends at the earliest of:

7 days after delivery;

When the goods are used;

When the original packaging is opened.

15.3 To cancel, you must notify us clearly by post or email before the deadline.

15.4 If Goods are not delivered within 30 days, you may cancel.

15.5 Refunds will be issued within legal timelines, excluding delivery costs.

15.6 Personalised/bespoke items cannot be cancelled unless defective.

16. Returns

Returned Goods must:

Be in original condition;

Be unopened, unused, and in original packaging.

Return postage cost is your responsibility unless Goods are defective.

17. Defects

17.1 Defects must be reported in writing within the warranty period. Genuine defects will be remedied or replaced at our discretion.

17.2 Minor variations in colour and appearance are not defects.

18. Complaints

18.1 Complaints should be emailed or posted to our Customer Service team.

18.2 We will respond within 14 days.

18.3 If unsatisfied, notify us in writing within 21 days.

18.4 We will respond to such notices within 7 days.

19. Website & Literature

Offers on the website are current at publication and may be withdrawn or amended at any time. Written quotations are valid for 28 days unless otherwise stated.

20. Recommendations

We recommend that Goods are used under supervision and according to our guidelines.

21. Force Majeure

Neither party is liable for delays caused by events outside reasonable control (e.g., strikes, fire, acts of government).

22. Independent Contractors

We and you are independent parties; neither may bind the other without written consent.

23. Assignment

You may not assign your rights without our written consent.

24. Severability

If any term is invalid, it will be severed and the remainder remains in effect.

25. Waiver

Failure to enforce a term does not constitute a waiver.

26. Notices

Notices may be sent by email, fax, personal service, or post to the address in the Specification Document.

27. Entire Agreement

This Agreement constitutes the entire contract between you and the Company.

28. No Third‑Party Rights

No third party may enforce rights under this Agreement.

29. Governing Law

These Terms are governed by the laws of England & Wales and the parties submit to the exclusive jurisdiction of the English courts.
